The major insurers have reduced their rates an average of 20% over the last five years. 2010 is continuing the trend as two professional liability carriers have recently announced lower rates effective April 2010.

The Doctors’ Company has announced an average rate decrease of 5.1% while Medical Protective has announced an overall premium decrease of 3%. These rate reductions are averages so individual physicians may see greater or lesser changes depending upon specialty, loss history and limits of liability. The Continental Casualty Company (CNA) has indicated that there will be no rate change this year.

It seems incomprehensible but it’s a fact: Medical providers and healthcare clinics willing to provide care without compensation receive very little legal protection in the way of charitable immunity laws. While physicians can usually obtain “charitable care” coverage through individual medical malpractice policies, the fact remains that volunteer physicians and surgeons still face the fear of lawsuits and the aggravation of defending themselves in the event of litigation. That’s simply not much of an incentive to motivate physicians and surgeons to willingly give of their time and expertise for the benefit of needy patients desperately needing medical care.

Norcal Mutual Insurance Company, a leading Medical Malpractice Insurance Carrier, has issued a statement on their efforts to support policyholders offering medical services in Haiti. Norcal will extend malpractice insurance coverage to physicians and surgeons who wish to travel to Haiti to provide volunteer charitable medical services. Coverage will be provided for claims instituted in the United States, its territories and possessions, Puerto Rico or Canada.
